CARPER VINUM - ALGEMENE VOORWAARDEN (see English below)

Algemeen

Onderstaande Algemene Voorwaarden zijn van toepassing op alle activiteiten voor

cursisten, gehouden door “Carper Vinum” te Zaandam.

Begrippen

Onder cursist wordt verstaan een deelnemer aan een cursus. In deze Algemene Voorwaarden wordt een deelnemer ook aangeduid als “u”.

Onder cursus wordt verstaan iedere activiteit van Carper Vinum in de breedste zin,

waaronder: Proef Wijn!, SDEN1, SDEN2, SDEN2 Horeca, SDEN3 en alle andere

cursussen en (thema) wijnproeverijen en evenementen.

Onderdelen van de Algemene voorwaarden

De Algemene Voorwaarden bestaan uit de volgende onderdelen:

Artikel 1: Aanvaarden van de Algemene Voorwaarden

Deze Algemene Voorwaarden staan vermeld op de website. ; www.carpervinum.nl

Bij het inschrijfformulier van Carper Vinum staat een verwijzing naar de Algemene Voorwaarden en op de factuur van de cursus. Bij het inschrijven op de cursus heeft de cursist tevens aangegeven de Algemene Voorwaarden te kennen en te accepteren.

Artikel 2: Inschrijving en betalingsverplichting

Inschrijving op een cursus geschiedt door middel van een aanmeldingsformulier op

internet. U (de cursist) heeft hiermee de verplichting op u genomen tot volledige

betaling van deze cursus, inclusief een eventueel examen. Bij het niet voldoen aan uw

betalingsverplichting schakelen wij een incassobureau in. Alle gemaakte kosten zijn dan

voor uw rekening, conform de staffel buitengerechtelijke incassokosten. Bij bedragen tot

2500 euro bedraagt dit 15% van de hoofdsom met een minimum van 40 euro.

Artikel 3: Annulering door de cursist

Voor een inschrijving op een cursus, inclusief een inschrijving voor een cursus die met

een cadeaubon betaald wordt, geldt geen bedenktermijn of herroepingsrecht. Bij

annulering van een cursus om welke reden ook vindt geen restitutie plaats. Een cursist

mag een vervangend persoon voorstellen aan Carper Vinum, tot maximaal 2 dagen vóór

aanvang van een cursus. Dit dient per mail te worden gemeld. Tijdens de duur van een cursus kan een cursist niet door een ander worden vervangen.

Artikel 4: Verhindering van de cursist door ziekte of overmacht

Er vindt geen restitutie van betaling of aanbetaling plaats indien de cursist door

omstandigheden verhinderd is bij een cursus, een deel van een cursus of een examen

aanwezig te zijn. Er is geen recht op vervangende cursusdagen.

Artikel 5: Cadeaubon

Bij de aanschaf van een cadeaubon geldt een bedenktermijn van 14 dagen. Binnen deze

termijn kunt u de cadeaubon aan ons retourneren en krijgt u de aanschaf terug gestort,

tenzij de cadeaubon reeds is gebruikt voor een cursus, of een reservering is gemaakt.

Artikel 6: Toelatingsbeleid

Carper Vinum heeft het recht een cursist voorafgaand aan een cursus te weigeren,

indien naar het oordeel van Carper Vinum deelname tot een conflict zou kunnen leiden.

Artikel 7: Wijzigingen van de cursusdata, locatie of docent

Carper Vinum behoudt het recht in het geval van onvoorziene omstandigheden zoals

ziekte van een docent of het niet beschikbaar zijn van de cursusruimte, de cursusdata

en/of de cursuslocatie te wijzigen, vooraf of tijdens de cursus. De cursisten zullen

hierover duidelijk geïnformeerd worden. Indien er een wijziging van een docent

plaatsvindt ontvangt de cursist hierover geen bericht, iedere docent voldoet aan de

normen van de Carper Vinum.

Artikel 8: Afbreken van de cursus door overmacht

Indien door overmacht de cursus door Carper Vinum moet worden afgebroken zal het

cursusgeld terug worden betaald over de resterende cursusdagen met aftrek van het

ontvangen lespakket.

De waarde van het SDEN 1 lespakket is vastgesteld op € 10,-

De waarde van het SDEN 2 lespakket is vastgesteld op € 35,-

De waarde van het SDEN 3 lespakket is vastgesteld op € 50,

De waarde van de reeds genoten cursus-sessies wordt vastgesteld aan de hand van de

cursusprijs van dat moment. Overige kosten van cursisten zoals opgenomen vrije dagen,

reistijd of reiskosten, of andere immateriële schade worden niet vergoed.

Artikel 9: Annulering van de cursus door Carper Vinum

Indien het minimum aantal van 6 deelnemers voor een cursus niet gehaald wordt kan

de cursus door Carper Vinum geannuleerd worden. De cursisten zullen daarvan uiterlijk

2 dagen voor aanvang van de cursus op de hoogte gesteld worden. Het betaalde

cursusgeld zal binnen 7 dagen retour gezonden worden.

Artikel 10: Geen aansprakelijkheid door vermissing of schade

Carper Vinum aanvaardt geen aansprakelijkheid voor schade door vermissing van

kleding of eigendommen of door anderen aangerichte schade tijdens de cursus.

Artikel 11: Geen aansprakelijkheid voor alcoholgebruik

De docent zal nimmer aanzetten tot overmatig alcoholgebruik door cursisten. De wijnen

die geschonken worden zijn bedoeld als proefwijnen. Carper Vinum is niet aansprakelijk

voor de gevolgen van alcoholgebruik voor, tijdens en na de cursus. De cursist is zelf

verantwoordelijk voor een verstandig alcoholgebruik, met name waar het de

verkeersveiligheid en medicijngebruik betreft.

Artikel 12: Cursusmateriaal en copyright

Het is niet toegestaan zonder schriftelijke toestemming cursusmateriaal te vermenigvuldigen en te verspreiden.

De copyright van de hand-outs, beeldmateriaal en overig cursusmateriaal berust bij de

Carper Vinum. Deze materialen zijn uitsluitend bestemd voor de cursist die hiervoor aan de Carper Vinum betaald heeft. Het is niet toegestaan cursusmateriaal te vermenigvuldigen en te verspreiden zonder schriftelijke toestemming van Carper Vinum.

Artikel 13: Beantwoording van vragen

Carper Vinum verplicht zich om alle vragen met betrekking tot het onderwijs of van

administratieve aard zo snel mogelijk, uiterlijk binnen 14 dagen te beantwoorden.

Indien er voor beantwoording meer tijd nodig is (bijvoorbeeld omdat wij informatie van

derden nodig hebben) zullen wij u daarvan op de hoogte stellen, en een nieuwe termijn

benoemen.

KLACHTENPROCEDURE

Deze klachtenprocedure is 24 uur per dag beschikbaar op onze website:

www.Carper Vinum.nl onder “Algemene Voorwaarden voor Cursussen”.

Deze Algemene Voorwaarden vindt u bij het inschrijfformulier .

We doen ons uiterste best om u een kwalitatieve en inspirerende cursus,

evenement, wijn en spijscursus, masterclass, introductiecursus, wijn-studiereis,

wijncursus in het buitenland of ander evenement aan te bieden. Indien u een

vraag of bezwaar heeft horen wij dat graag direct van u, zodat we samen

kunnen kijken hoe we tot een bevredigende oplossing komen. De algemene

voorwaarden zijn leidend bij het beantwoorden van een klacht.

Indien u echter vindt dat uw klacht niet goed gehoord of beantwoord is kunt u deze per

e-mail indienen. Een antwoord krijgt u van ons per e-mail.

Omschrijving van de klacht

Ontvangstbevestiging

U ontvangt zo snel mogelijk, uiterlijk binnen 7 dagen, een ontvangstbevestiging.

Behandeling van uw klacht

Alle klachten worden door Carper Vinum afgehandeld. Een uitzondering hierop vormen

klachten over de lesboeken.

Hier heeft Carper Vinum geen invloed heeft, omdat Carper Vinum gebruik

maakt van het lesmateriaal van Stichting Platvorm Dranken. Deze klachten sturen wij door naar Stichting Platvorm Dranken.

Beantwoording van uw klacht

Wij streven ernaar elke klacht op korte termijn, uiterlijk binnen 4 weken, naar

bevrediging beantwoord te hebben. Indien er meer tijd nodig is om een klacht af te

handelen zullen wij u hiervan op de hoogte stellen met een motivatie en de te

verwachten tijdsduur. Alle relevante informatie die wij over uw klacht ontvangen zullen

wij binnen 7 dagen aan u verzenden.

Vertrouwelijkheid

Uw klacht wordt vertrouwelijk behandeld en niet met derden gedeeld.

Registratie

Van elke klacht wordt een registratie bijgehouden die gedurende 1 jaar bewaard blijft.

Deze registratie dient ter controle van onze erkenning als onderwijsinstituut.
